Summary
In the present report, the Special Rapporteur on the human rights of migrants, Gehad
Madi, examines the phenomenon of migrants who go missing or are subjected to enforced
disappearance from a human rights perspective. He illustrates the multiple causes of
disappearances, including enforced disappearances, which not only infringe upon the human
rights of disappeared migrants, but also, in many cases, directly affect the right of their
families to know the truth about the circumstances of such disappearances because of failure
to adequately investigate the whereabouts of and, if possible, identify disappeared migrants.
The Special Rapporteur emphasizes the shared responsibility of countries of origin, transit
and destination to establish effective mechanisms of cooperation to ensure prevention, rescue
and search operations for migrants in distress, the investigation and, where applicable,
sanctioning of such cases. The Special Rapporteur promotes the establishment of a truth and
monitoring mechanism to ensure accountability, justice, reparation and guarantees of
non-repetition for migrant disappearances, in line with State obligations under international
law.
