Articles 7 and 8 in the Framework Convention guarantee, for persons belonging to national
minorities, the freedom of religion as well as the right to manifest religion and establish
religious institutions, organisations and associations. This last mentioned right is also found in
the right to education in Article 2 of Additional Protocol I to the European Convention for the
Protection of Human Rights and Fundamental Freedoms.16 Pursuant to Article 17 of the
European Convention of Human Rights, on the prohibition of abuse of rights, religious
teaching or education, or indeed any other kind of education, should not lead to the violation
of the rights of others (whether they are of the same or different religious beliefs). In addition
to the school subjects discussed above, all school subjects, including mathematics,
gymnastics, music and arts will also need to be reviewed and adapted from a multicultural and
intercultural perspective.

Article 2 of the additional Protocol states that ‘No person shall be denied the right to education. In the exercise
of any functions which it assumes in relation to education and to teaching, the State shall respect the right of
parents to ensure such education and teaching in conformity with their own religious and philosophical
convictions’. The European Court of Human Rights has had the opportunity to pronounce on this provision on
several occasions.
