1.1
The claimant is L.E.M., a national of Cameroon born in 1984. He is facing deportation
to Cameroon and is of the view that being deported would constitute a violation by the State
party of article 3 (1) of the Convention. The State party has made the declaration pursuant to
article 22 (1) of the Convention, effective from 2 December 1986. The complainant is
represented by counsel.
1.2
On 15 February 2021, pursuant to rule 114 of its rules of procedure, the Committee,
acting through its Rapporteur on new complaints and interim measures, decided to grant the
complainant’s request for interim measures.
1.3
On 25 February 2021, the State party informed the Committee that, in accordance
with its established procedure, the State Secretariat for Migration had requested the
competent authority to refrain from taking any steps to deport the complainant, who would
therefore be able to remain in Switzerland pending the consideration of his complaint by the
Committee or a decision to put an end to the suspensive effect.
