Report of the Special Rapporteur on the human rights
of migrants
Summary
The present report, on activities carried out between June 2009 and July 2010,
is submitted pursuant to General Assembly resolution 64/166 and Human Rights
Council resolution 8/10.
The report summarizes the activities undertaken by the Special Rapporteur on
the human rights of migrants during the period under review and focuses on the
impact of the criminalization of migration on the protection and enjoyment of human
rights. The report highlights the detrimental consequences of such policies on groups
that should not be considered aprioristically as irregular migrants, including victims
of human trafficking, asylum-seekers and children. The report also provides
examples of good practices in the mainstreaming a rights-based approach to
migration and managing irregular migration without resorting to its criminalization.
The report concludes with recommendations for further consideration and action by
Member States and other stakeholders.
