Under such circumstances, I cannot agree with the conclusion the State party came to, having sufficiently examined and assessed the relevant facts through adequate proceedings, that no real risk of irreparable harm would exist also on the basis of the author’s conversion. Accordingly, I have to conclude that the assessment by the State party was clearly arbitrary or amounted to a manifest error or denial of justice and therefore the deportation of the author to Afghanistan would constitute a violation of articles 6 and 7 of the Covenant in the light of his conversion. 16
