India replied by recalling the legal and institutional guarantees of non-discrimination for all communities, including minorities. India’s policy is based on a commitment to safeguarding the interests of minorities and to ensuring that any violent incident is met with action by the State against the perpetrators of the act within the framework of the law. The reply went on to say: “The incidents reported are actually incidents of law and order/crime related to thefts, personal enmity, land/property disputes, disputes over admissions/fee hikes in schools, etc. which cannot be construed as communal. In the case of Uttar Pradesh, a team from the National Commission for Minorities had visited various places of occurrence and substantiated the foregoing acts and concluded that no communal angle was evident and no organized/unorganized group was responsible for the incidents.” 60. According to a communication from the Special Rapporteur, in March 2000 acts of vandalism were perpetrated against a technical training institute run by the Capuchin Fathers in Surya Nagar. 61. India replied: “In the night of 12/13 March, some unknown antisocial elements, after breaking open locks of Media House (a computer institution) at Surya Nagar, Ghaziabad, took away the CPUs of computers along with some other articles. The local police have registered a case under relevant provisions of law, and the matter is under investigation. Thus, this is a clear case of theft.” 62. According to a communication from the Special Rapporteur, in March 2000 the Sacred Heart School and its principal were attacked. 63. India replied: “On 6 April 2000 (and not on 6 March 2000, as stated in the communication) a Dharana (sit-in strike) was organized by the students and parents in front of Sacred Heart School, Mathura, against a hike in school fees and an increase in the percentage for passing in the examinations from 33 to 40 per cent. The issue was settled peacefully on 13 April 2000 in a meeting with the parents and school management and local administration.” 64. According to a communication from the Special Rapporteur, in April 2000 three nuns were reportedly assaulted in Haryanan while on their way to the Rewari Catholic church to celebrate Easter.
