The Victims of Crime Directive
126. The Directive of the European Parliament and of the Council establishing minimum
standards on the rights, support and protection of v ictims of crime (Victims of Crime
Directive 2012/29/EU), states in its Art 1 that the rights set out in the Directive shall apply
to victims in a non-discriminatory manner, including with respect to their residence status.
Art 5.2 provides that Member States shall ensure that victims who wish to make a
complaint with regard to a criminal offence and who do not understand or speak the
language of the competent authority be enabled to make the complaint in a language that
they understand or by receiving the necessary linguistic assistance. Article 7 provides for
the right to interpretation and translation during criminal proceedings. Shelters or any other
appropriate interim accommodation shall be provided for victims in need of a safe place
due to an imminent risk of secondary and repeat victimisation, of intimidation and of
retaliation (Art 9.3(a)).
