Proposes that the Human Rights Council include the Expert Mechanism and
representatives of indigenous peoples in the Human Rights Council review from the
earliest possible stage of the process, with a view to ensuring that the results of the review
are such that they help to further strengthen the work of the Expert Mechanism and the
capacity of the Human Rights Council to promote and protect the rights of indigenous
peoples.
Proposal 4: Review of developments pertaining to the promotion and protection of
the rights of indigenous peoples pursuant to the provisions of the United Nations
Declaration on the Rights of Indigenous Peoples

The Expert Mechanism on the Rights of Indigenous Peoples
(a)
Refers to article 42 of the United Nations Declaration on the Rights of
Indigenous Peoples which obliges the United Nations, its bodies, specialized agencies and
States to promote respect for and full application of the provisions of the Declaration and
to follow up the effectiveness of the Declaration;
(b)
Proposes that the Human Rights Council authorizes the Expert Mechanism,
on an annual basis, to review developments pertaining to the promotion and protection of
the rights of indigenous peoples pursuant to the provisions of the Declaration on the Rights
of Indigenous Peoples, and to give the Human Rights Council thematic advice on possible
steps to be taken to achieve the objectives of the Declaration.

The Expert Mechanism on the Rights of Indigenous Peoples
(a)
Refers to article 38 of the United Nations Declaration on the Rights of
Indigenous Peoples which establishes a duty for States, in consultation and cooperation
with indigenous peoples, to take appropriate measures, including legislative measures, to
achieve the objectives of the Declaration;
(b)
Proposes that the Human Rights Council encourage States, in consultation
and cooperation with indigenous peoples, to adopt appropriate measures, including
administrative and legal measures, as well as overall implementation strategies, and follow
up these measures and strategies in order to ensure respect for and full application of the
Declaration.
Proposal 6: Mandate of the Voluntary Fund for Indigenous Populations

The Expert Mechanism on the Rights of Indigenous Peoples
(a)
Welcomes the request made by the Human Rights Council, as reflected in
paragraph 9 of resolution 12/13, that OHCHR prepare a detailed document outlining the
practical implications of a change in mandate of the Voluntary Fund, in particular if it is
expanded, the current working methods and resources of the Fund.
(b)
Proposes that the Human Rights Council take further steps in its
forthcoming session towards the implementation of the earlier proposal of the Expert
Mechanism to expand the mandate of the Fund.
