58. On 28 November 1988, the Permanent Mission of Pakistan communicated the
reply of the Pakistan authorities to the Special Rapporteur. This reply,
which also referred to information concerning Pakistan contained in the
previous report of the Special Rapporteur (E/CN.4/1988/45, para. 15) and the
reply of the Pakistan authorities commenting on this information
(E/CN.4/1988/45/Add.l and Corr. 1), stated in particular:
"There is no discrimination against Ahmad is. They have freedom of
expression and bring out religious and other publications. They have the
right of association and hold religious meetings and conventions, as well
as prayer congregations. The necessary facilities are provided for such
meetings. Appropriate measures are taken to protect Ahmadi places of
worship and to maintain their sanctity. No Ahmadi has been dismissed
from government employment on grounds of religion. Ahmadis hold
important positions in the services of Pakistan, both civil and military,
and are leading figures in the economic and business community.
"With regard to the charges that members of the Ahmadiyya community
have been arrested solely for the expression of their religious belief,
it is clarified that when such arrests have taken place they have been
motivated by the aim of upholdinq the law and only in cases when the
members of this community have acted in breach of the law. Application
of the law cannot and should not be interpreted as a breach of religious
tolerance.
"After the liftinq of Martial Law in Pakistan in December 1985, the
constitutional quarantees relating to the fundamental riqhts of all
citizens were restored and the authority of the judiciary fully
re-established. The restoration of democracy and the restitution of
fundamental riqhs in Pakistan, as well as the full authority of the
judiciary, ensure that the rights of the Ahmadis, as of every citizen of
Pakistan, are fully safequarded by the due processes of law.
"The Government of Pakistan deems it a duty to promote the welfare
of non-Muslim citizens, to ensure tolerance for their faith and to
provide them with opportunities to lead their lives honourably and
accordinq to their beliefs. A Federal Ministry of Minorities Affairs is
charqed with the responsibility of protectinq their riqhts and takinq all
possible measures for their well-beinq and economic, social and
educational advancement.
"It is, however, becoming increasingly clear that some Ahmadis have
launched a campaign of hatred aqainst the Government and people of
Pakistan and that their constant allegations, which are invariably found
to be baseless, are nothinq but a disinformation campaiqn motivated by a
desire to maliqn Pakistan.
"The Ahmadiyya question needs to be evaluated objectively and in its
proper perspective. The Government of Pakistan would, once aqain, like
to reiterate that there is no campaiqn of persecution aqainst the
Ahmadis. It stronqly rejects the alleqation that any qovernment aqency
has resorted to authorizinq discrimination aqainst Ahmadis in Pakistan.
Conversely, the Government has endeavoured to protect the riqhts of the
Ahmadis and adopted measures to pre-empt developments which could create
a law and order situation."
