In its reply, the Government of the United States of America did not
specifically answer this question. However, in its general reply, it referred
thereto as follows:
"In addition to these constitutional protections, certain U.S. statutes
guard against religious intolerance. The United States provides a statutory
exemption from combatant military training and service (50 U.S.C.A. APP.
SEC. 456). The exemption applies to those who by reason of religious training
and belief are conscientiously opposed to participation in war in any form.
Under the statute, the term "religious training and belief" does not include
essentially political, sociological or philosophical views or a merely
personal moral code. However, the U.S. Supreme Court has held that the
statutory exemption from military service applies to all persons who are
opposed to war in any form on the basis of beliefs which are the functional
equivalent of a theistic religious belief."
